IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M No.16996 of 2024 Date of Decision: 08.04.2024 SUBHASH CHANDER ......Petitioner(s) Vs STATE OF HARYANA AND ANOTHER ....Respondent(s) CORAM: HON'BLE MR. JUSTICE HARKESH MANUJA

Present:

None for the petitioner.

Mr. Rajiv Sidhu, D.A.G., Haryana.

**** HARKESH MANUJA, J. (Oral) By way of present petition filed under Section 482 Cr.P.C., prayer has been made for quashing the FIR No.649 dated 06.12.2023 registered under Section 506 IPC at Police Station City Fatehabad, District Fatehabad along with all other subsequent proceedings arising thereform.

At the first call, learned counsel for the petitioner appeared and requested for a pass over, however despite the matter called twice thereafter no one has chosen to appear on behalf of the petitioner. I have gone through the contents of the petition as well as the FIR. Upon, advance notice Mr. Rajiv Sidhu, D.A.G., Haryana appears on behalf of the respondent/State and informs that during the investigation some recorded conversation of petitioner and complainant has also surfaced which prima facie supports the contents made in the FIR and in view thereof, the veracity and validity of contents of the FIR which apparently discloses cognizable offence against the petitioner needs to be gone into in trial being a matter of evidence. In view of above, finding no merit in the present petition, the same is dismissed.
