This is an application for placing on record reply on behalf of respondents No.1, 3 and 4 by way of affidavit of Block Development and Panchayat Officer, Nadala, District Kapurthala, Punjab. Allowed as prayed. The reply is taken on record. CWP-PIL-77-2024 :
The present PIL has been filed alleging public cause that the representation of the petitioner dated 23.02.2024 (Annexure P-8) is not being decided, wherein, grievance has been raised regarding unlawful allotment of 5 Marlas plot in favour of respondents No.6 to 10 by respondent No.5 - Gram Panchayat, Village Sikri. -2The State has filed an affidavit dated 20.01.2025, which, inter-alia, reveals that vide order dated 10.01.2025, an inquiry has been initiated to inquire into the veracity of the complaint of the petitioner, giving notice to the Sarpanch, Panchayat Secretary, Ex.Sarpanch and Panchayat Officer (Samiti) Nadala.
In view of the above, we find that the steps have been taken by the respondents to inquire into the allegations made by the petitioner, therefore, this Court deems it appropriate not to keep the petition pending.
Hence, the petition is disposed of with direction to the respondent - State to conduct a free and fair inquiry as expeditiously as possible and conclude the same, preferably within sixty days from today, failing which the petitioner shall be at liberty to re-visit the Court.
