(ORAL) Prayer in this petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 179 dated 25.02.2022 registered under Section 4 of the Protection of Children from Sexual Offences Act, 2012 and Sections 363 and 366 IPC at Police Station Rajindra Park, Gurugram.

Learned counsel for the State has filed custody certificate dated 24.08.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 01 year, 02 months and 23 days.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.
