The petitioner seeks grant of interim bail for a period of one week so as to attend the marriage of his real brother namely Rajwinder Singh, which is to be solemnized on 5.4.2024.

Pursuant to directions issued by this Court vide order dated 3.4.2024, learned State counsel, upon instructions from ASI Kansraj, has informed that the factum of marriage of petitioner's real brother namely Rajwinder Singh has been verified and found to be correct. It has also been informed that the petitioner happens to be involved in 2 other cases registered under NDPS Act. Learned State counsel has, however, informed that the petitioner as on date has been behind bars since the last about 4 months and 12 days. This Court has considered the rival submissions addressed before this Court. 4.

Having regard to the facts and circumstances of the case particularly bearing in mind that petitioner's real brother is to get married on 5.4.2024, it goes without saying that the petitioner would be required to perform certain rites and ceremonies in respect of marriage of his real brother. The instant petition, as such, is accepted to the limited extent that the petitioner is permitted to attend the marriage of his real brother namely Rajwinder Singh, which is to be solemnized on 5.4.2024, while in custody. 5.

The Superintendent, Central Jail, Gurdaspur shall do the needful for taking the petitioner while in custody to the venue of marriage of his real brother today i.e. 4.4.2024 as well as on 5.4.2024 in the morning and consign him back in the jail on the evening of 4.4.2024 and 5.4.2024. 6.

The aforesaid order shall, however, be subject to the condition that the family/relative of the petitioner deposits the expenses in advance, which are to be incurred for taking the petitioner to the venue of marriage of his real brother and to consign him back in jail.
