The petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.498 dated 12.12.2015 registered for the offences under Sections 323, 324, 341, 506 and 34 IPC and (Sections 326 and 307 IPC, which were added later on) at Police Station Sector 11, Chandigarh.
I have heard learned counsel for the petitioner and have gone through the record.
The FIR was registered on 12.12.2015 and as per the arguments, the petitioners were arrested on the same day and have been released by the Court on regular bail on 15.12.2015 for the offences under Sections 323, 324, 341, 506 and 34 IPC. A perusal of the record shows that in the present case Mukesh Kumar is the owner of the `Dhaba' and the other accused Arun Masih and Rahul Masih are his sons. Cr. Misc. No.M-30124 of 2016 [2] injuries were given to the complainant Narinder as well as his friend Vir Singh. Both have received injuries on their heads and as per the impugned order passed by the learned Additional Sessions Judge, the injuries on the heads of the injured were found as fracture of left parietal bone and the offences under Sections 326 and 307 IPC have been added. Keeping in view the nature and gravity of the offences, I do not find it a fit case where the present petitioners are entitled to the benefit of anticipatory bail.
Therefore, finding no merit in this petition, the same is dismissed.
