**** Manjari Nehru Kaul, J.(Oral) Instant petition has been filed under Section 482 Cr.PC for quashing of orders dated 29.03.2022 and 16.12.2022 (Annexures P-1 & P-2) passed by JMIC, Ludhiana in case FIR No.180 dated 04.06.2018 under Section 420 IPC registered at P.S. Division No.5, District Ludhiana vide which the petitioner was declared as a Proclaimed Offender.

Learned counsel for the petitioner submits that the petitioner was granted interim bail by the trial Court vide order dated 30.03.2020 and thereafter, he was regularly appearing before the Court concerned. But due to some misunderstanding, the petitioner could not appear before the Court concerned and was declared a proclaimed person vide impugned order. He further submits that the statutory provisions under Section 82 Cr.PC were not followed before passing the impugned order. Learned counsel still further submits that the petitioner is ready to appear and surrender and thereafter join proceedings before the trial Court. Notice of motion.

CRM-M-16949-2023 -22023:PHHC:049032 On the asking of Court, Mr. Ramdeep Pratap Singh, Sr. DAG, Punjab accepts notice on behalf of the respondent-State. In view of the submissions made above, the petition is disposed of with directions to the petitioner to appear and surrender before the trial Court on or before 18.04.2023 and move appropriate application for grant of bail. Till then no coercive steps be taken against the petitioner. The trial Court on such application being moved shall decide it expeditiously in accordance with law. It is, however, made clear that in case the petitioner fails to appear and surrender before the Court below within the above stipulated time period, then this order shall be of no avail to him.
