Challenge in the present petition is to the rejection of the candidature of the petitioner for appointment to the post of Multipurpose Health Worker (MPHW) Male for which he applied, in pursuance of advertisement No. 01/2015 dated 19.06.2015, with a prayer to grant 10 marks for socio economic criteria.

The petitioner was declared ineligible under OSP-SC category on his inability to produce the sports gradation certificate, however, it was only in compliance of the interim order dated 24.05.2018 passed by this Court, the previous writ petition filed by him, he having been provisionally considered under SC category and secured 77 marks, while the cut-off was 85. 3.

Learned State counsel has drawn the attention of this Court to the advertisement, as per which, no marks were to be granted for socio economic criteria, which the learned counsel for the petitioner is unable to rebut or substantiate the basis for grant of additional marks.
