CORAM : HON'BLE MR. JUSTICE JASPAL SINGH Present :

Mr. Arshdeep Singh, Advocate, for the petitioners.

Mr. J.S. Sekhon, Assistant Advocate General, Punjab, for respondent No.1.

Mr.Varun Sharma, Advocate, for respondent No.2.

***** JASPAL SINGH, J.

This petition has been preferred under Section 482 of the Code of Criminal Procedure for quashing of FIR No. 48, dated July 26, 2015, under Sections 324, 323, 34 of IPC, registered at Police Station Qila Lal Singh, District Batala (Annexure P-1) along with all consequential proceedings arising out of the same on the basis of compromise (Annexure P-2).

2.

In compliance of order dated March 10, 2016, statement of the parties have been recorded by the trial Court. Report of learned Judicial Magistrate, 1st Class, Batala, has been received, in

ANKUR GOYAL 2016.04.27 11:55 I attest to the accuracy and authenticity of this document CRM No.M-29249 of 2015 -2 - ***** which, it has been categorically observed that parties have arrived at compromise with their free will, without any pressure or coercion from any quarter. Even otherwise, matter involved is personal in nature, which has been amicably put at rest.

3.

In view of the above, I am of the considered opinion that continuation of criminal proceedings between the parties would be an abuse of the process of law and the present compromise is for their benefit and will bring peace and harmony between them. 4.

Consequently, instant petition stands allowed and FIR No. 48, dated July 26, 2015, under Sections 324, 323, 34 of IPC, registered at Police Station Qila Lal Singh, District Batala (Annexure P-1) and all other subsequent proceedings arising therefrom are quashed qua the petitioners.
