***** Rajan Gupta, J. (Oral) This is a petition filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case registered against him vide FIR No.93 dated 01.09.2016 under Sections 22/61/85 of NDPS Act, at Police Station Mahilpur, District Hoshiarpur, Punjab.

Petitioner was allegedly found in possession of 29 injections (2 ML each) Buprenorphine and 31 injections of Pheniramine Malteat, which prosecution claims is a commercial quantity.

Learned State counsel submits that out of eleven witnesses cited by the prosecution, four have been examined. Prosecution shall endeavour to conclude its evidence at the earliest.

In view of the above, present petition is dismissed at this stage. However, fresh right shall accrue to the petitioner to move the court to seek bail, in case, trial does not conclude within a period of three months.
