3. Whether the judgment should be reported in the Digest? AJAY TEWARI, J. (Oral) This petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case F.I.R. No.95 dated 05.08.2015 registered under Sections 452, 355 and 323 IPC at Police Station Sadar Kotkapura, District Faridkot.

Mr. Amaninder Preet, Advocate has entered appearance on behalf of the complainant.

Learned counsel for the petitioner has argued that all the offences are bailable and Section 452 IPC has been invoked only to make the offences non-bailable.

   Learned counsel for the complainant has however argued that the petitioner has entered into the house of the complainant and has given blows and pulled his hair and beard. It has also been stated that two other FIRs are pending against the petitioner that he is a person with criminal bent of mind.

Be that as it may, in case the petitioner is found guilty he would be liable to suffer whatever imprisonment is imposed upon him but at this stage I do not deem it appropriate to deny the concession of anticipatory bail to the petitioner.

Resultantly, the petition is allowed.

In the event of arrest of the petitioner, he shall be released on bail to the satisfaction of the Investigating Officer subject to the conditions envisaged under Section 438(2) Cr.P.C. Since the main case has been decided, the pending criminal miscellaneous application, if any, also stands disposed of.
