**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 567 dated 12.10.2016 under Sections 302/34/120-B IPC and Section 25 of the Arms Act, 1959 registered at Police Station Sampla, District Rohtak. Vide order dated 19.12.2019, the Co-ordinate Bench of this Court directed the Superintendent of Police to file an affidavit as to why the trial is being delayed.
In compliance to the said order, affidavit of Superintendent of Police, Rohtak dated 28.1.2020 has been filed which is taken on record. As per the affidavit, trial was going on but on some occasions, the date was sought. It has also been stated that one prosecution witness namely Balbir Singh died and death report was called from the SHO. Thereafter because of unavoidable reason, one more date was taken. CRM-M No. 30257 of 2018 -2prosecution witnesses, 14 witness have been examined and the next date before the trial Court is fixed for 20.2.2020. No case for grant of regular bail to the petitioner is made out. The petition is dismissed.
