Mr. Satya Pal Jain, Additional Solicitor General of India with Ms. Sonia Sharma, Advocate for respondents No.1 to 5. ***** MAHABIR SINGH SINDHU, J Present civil writ petition has been filed under Articles 226/227 of the Constitution of India praying for issuance of writ of certiorari setting aside the impugned letter dated 22.07.2019 (P-1) declaring the petitioner as an unauthorized occupant of the government accommodation and liable to pay damage rent and the show cause notice dated 13.08.2019 (P-2) issued under Sub-Section (3) of Section 7 of the Public Premises (Eviction of Unauthorized Occupants) Act, 1971, thereby calling upon the petitioner to show cause as to why order requiring him to pay damage rent should not be made.
This Court, on January 14, 2021 passed the following order:- "Learned counsel for the respondents seeks time to apprise the Court as to whether Armed Forces Tribunal has started working and take up the matters which were filed prior to imposition of first lockdown w.e.f. 25.03.2020.
Posted on 29.01.2021."

CWP-8220-2020(O&M) -2Today, learned Additional Solicitor General of India Mr. Satya Pal Jain, on instructions from the concerned quarter, has apprised the Court that the Armed Forces Tribunal is very well functioning and taking up the cases while following due protocol.
Faced with the situation, learned counsel for the petitioner wishes to withdraw the present petition with liberty to pursue the remedy already pending before the Tribunal.
