Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 439,Cr.P.C., is for grant of regular bail to the petitioner, Harjit Kaur, who has been booked for having committed the offences punishable under Sections 120-B, 406 and 420, IPC, in a case arising out of FIR No.82, dated 19.06.2015, registered at Police Station, Sadar, Phagwara, District Kapurthala. Learned counsel contends that all the offences, for which the petitioner has been booked, are triable by learned Judicial Magistrate Ist Class; the maximum sentence prescribed for the offences for which she has been booked is rigorous imprisonment for seven years beside the payment of fine; after completion of the investigation, the charge-sheet (report under Section 173, Cr.P.C.) has been presented before learned trial SEEMA RANI 2015.09.04 15:45 I attest the accuracy and authencity of the document

Court and that the petitioner is a woman, who is behind the bars from 22.06.2015 and her further incarceration would not be of any worth.

Learned counsel for the State has not controverted the above factual aspects. However, he, on instructions from ASI Santokh Singh, Police Station, Sadar, Phagwara, submits that the petitioner is involved in one more case of similar offence. I have heard learned counsel for the parties and with their able assistance gone through the material available on record.

Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Harjit Kaur, w/p Harmaljit Singh, r/o House No.1925, Sector 22, Chandigarh, now r/o 827, 3V, Mohali, is directed to be released on bail, during pendency of trial of the present case, subject to her furnishing bail bonds to the satisfaction of learned trial Court.
