Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in FIR No.148 dated 05.08.2014, under Sections 489-B, 489-C and 120-B of the Indian Penal Code, 1860 ('IPC' for short) registered at Police Station Sadhaura, District Yamuna Nagar.

Learned counsel for the petitioner has submitted that petitioner is in custody since 20.08.2014. Co-accused Jai Parkash has been granted bail by this Court vide order dated 27.05.2015. Petitioner was not arrested at the spot but was later involved in the case on the basis of disclosure

Learned State counsel, on the other hand, has opposed the petition and has submitted that fake currency to the tune of `1,20,000/- were recovered from the petitioner. Now only one prosecution witness remains to be examined and trial is near conclusion.

In the present case, the case of the petitioner cannot be said to be strictly on a similar footing as accused Jai Parkash. So far as accused Jai Parkash is concerned, fake currency to the tune of `11,000/- was recovery from him, whereas, from the petitioner fake currency to the tune of `1,20,000/- was recovered. Moreover, trial is near conclusion and only one prosecution witness remains to be examined. Hence, keeping in view the above facts, no ground for grant of bail to the petitioner, is made out. Dismissed.
