ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of mandamus directing the respondents to issue Sports Gradation Certificate under appropriate grade as per policy dated 25.05.2018 (Annexure P-9).

Respondent-Commission invited applications for Group-D posts in ESP BC-B category. Petitioner, being eligible, applied for the same and participated in the selection process. Final result dated 19.01.2019 was withheld as the sports policy was under challenge. Thereafter, new sports policy of 2018 came into effect. Petitioner was called for scrutiny of documents vide letter dated 12.02.2022 (Annexure P-2). Office letter dated 04.03.2022 (Annexure P-5) was issued asking the aspirants to fill the application form by 31.03.2022 for fresh Sports Gradation certificate. He applied for the same in view of new policy on 17.03.2022 (Annexure P-6) with requisite documents. Gradation certificate has been issued to the other similarly situated persons but the petitioner's is still pending. He apprehends that the respondents will meanwhile declare the final result and he will loose the opportunity of employment.

Petitioner also submitted representation dated 07.04.2022 (Annexure P-11) but the same has not been adverted till date. Hence the petition.

On advance service, learned state counsel appears and submits that a decision will be taken by competent authority, either way, on the pending representation dated 07.04.2022 (Annexure P-11) by passing a speaking order.

At this stage, learned counsel for the petitioner also seeks decision on the pending representation as suggested by learned state counsel.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the respondents to look into the representation dated 07.04.2022 (Annexure P-11) of the petitioner and pass an administrative order, in accordance with law. 8.

Let the needful be done within six weeks from today. 9.

Disposed of accordingly.
