Petitioner has filed this third petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.213 dated 09.09.2017 under Sections 18 and 22 of the NDPS Act, registered at Police Station Sadar, Ludhiana.

Notice of motion.

Mr.Dhruv Dayal, Sr.DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per prosecution version, opium weighing 3 kgs. and heroin weighing 217 grams have been recovered in the present case. The recovery falls under commercial quantity. Therefore, finding no merit in the present petition, the same is dismissed.

However, as the petitioner is stated to have been in custody since 09.09.2017, therefore, learned trial Court is directed to expedite the trial.
