(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to petitioner - Kapil Juneja in case FIR No.64 dated 04.04.2017 under Sections 406 and 420 IPC read with Section 24 of the Immigration Act and Section 13 of the Punjab Travel Professional Regulation Act, 2014 registered at Police Station Navi Baradari, Jalandhar. Allegations against the petitioner are that he dishonestly induced and cheated complainant - Kulwant Singh and others to make payment of ` 4.2 lakh on the pretext of sending them in the Arab countries like Behrin and UAE by publishing a notice in the newspaper and thereafter handed over fake visas and tickets to them.

The petitioner neither sent the complainant and other persons abroad nor returned their money. Learned counsel for the petitioner contends that there is no specific allegation against the petitioner. Even it is not evident from the contents of the FIR that any inducement was ever made by the petitioner or Ravinder Singh 2017.08.18 10:52 I attest to the accuracy and authenticity of this document any money was paid by the complainant. No date and time of alleged payment has been mentioned in the FIR.

-2CRM-M-29360 of 2017 Considering over all facts and circumstances and the fact that during investigation by an officer of the rank of Additional Deputy Commissioner of Police, the petitioner is found to have cheated 11 persons, the custodial interrogation of the petitioner is very much necessary to enquire as to how many persons have been cheated and have been given fake visas and tickets, including the complainant. Accordingly, the petition is dismissed.
