(ORAL) Pursuant to order dated 31.01.2017, learned State counsel, on instructions from ASI Mahender Singh, submits that though the quantity of the poppy husk recovered from the co-accused of the petitioner is only 1 Kg. 100 grams, however, the petitioner himself has also been convicted earlier for an offence punishable under Section 15 of the Narcotic Drugs and Psychotropic Substances Act,1985, and the said case is still pending. Be that as it may, in view of the fact that the present recovery is of a small quantity from a co-accused of the petitioner and not from the petitioner himself, the petitioner is directed to join investigation. If he does so and is sought to be arrested, he shall be released on bail to the satisfaction of the arresting officer/Illaqa Magistrate concerned, subject to compliance of the conditions stipulated in Section 438(2) Cr.P.C.
