(Oral) Quashing of FIR No. 146 dated 28.06.2016 under Sections 498A/323/324 IPC and Section 4/5 of D.V Act subsequently added Section 326 IPC registered at Police Station Civil Lines Batala, District Gurdaspur, is being sought on the basis of compromise deed dated 29.07.2016 (P-2) Respondent No. 2 got married to Gurdev Singh son of the petitioner on 08.03.2015. Due to some misunderstanding, F.I.R was registered against the petitioner.

However, the matter has now been duly compromised, vide compromise deed dated 29.07.2016 (P-2).

In compliance of order dated 30.08.2016, report dated 16.12.2016 of Judl. Magistrate 1st Class, Batala has been received in this regard. As per report, statement of parties have been recorded. The complainant stated that the matter stands compromised between the parties and she does not want to proceed further against the accused. Crl. Misc. No. M-30249 of 2016 compromise has been entered voluntarily. To the same effect is the joint statement given by the petitioner.

Consequently, in view of the status report dated 16.12.2016 and in view of the judgment of the Hon'ble Supreme Court in cases of Dr. Arvind Barsaul etc. versus State of Madhya Pradesh and another 2008(2) RCR (Criminal) 910, Madan Mohan Abbot vs. State of Punjab 2008(2) RCR (Criminal) 429 and the law laid down by the Full Bench of this Court in the case of Kulwinder Singh and Ors. vs. State of Punjab and another 2007(3) RCR (Crl.) 1052, no useful purpose would be served in prolonging the litigation.

Accordingly, FIR No. 146 dated 28.06.2016 under Sections 498-A/323/324 IPC and Section 4/5 of D.V Act subsequently added Section 326 IPC registered at Police Station Civil Lines Batala, District Gurdaspur, is quashed along with all consequential proceedings arising therefrom qua petitioner.

The petition stands disposed of.
