Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No.213, dated 26.10.2014, under Sections 304-B and 34 of Indian Penal Code, 1860, registered at Police Station Israna District Panipat.

Heard.

Petitioner is in custody since 22.12.2014. Petitioner is aged about 70 years. Admittedly, material witnesses have not supported the prosecution case during trial.

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of the Chief Judicial Magistrate, Panipat.
