By way of second petition filed under Section 482 Cr.P.C., prayer has been made for quashing of FIR No.504 dated 20.10.2020 registered under Sections 323, 34, 506 IPC at Police Station City Fatehabad, District Fatehabad (Annexure P-1) along with all consequential proceedings arising therefrom. [2].

Learned counsel for the petitioner vehemently submits that the FIR in question is a counter-blast to the FIR No.503 dated 20.10.2020 registered under Sections 147, 149, 294, 323, 354-A IPC at Police Station City Fatehabad, District Fatehabad which was got registered at the instance of petitioner against respondent No.2 besides few others and, thus, the same was totally misuse and an abuse of process of law.

I have heard learned counsel for the parties and gone through the contents of the paper book.

Perusal of Annexure P-4 at page No.22 of the paper book would show that previously also a similar petition was filed bearing CRM-M No.43192 of 2020 wherein having argued the same, learned counsel for the petitioners withdrew it to raise all pleas before the Trial Court at appropriate stage. [5].

In view of above, the present petition cannot be now entertained on merits, the same is disposed. However, the petitioner shall continue to have opportunity to take all those please before the Court concerned.
