Versus

State of Punjab ........................................................... Respondent CORAM : HON'BLE MRS. JUSTICE LISA GILL ...

Present:

Mr. J.S.Thakur, Advocate for the petitioner.

Ms. Seena Mand, DAG, Punjab.

...

LISA GILL, J. (Oral) The petitioner seeks the concession of anticipatory bail in FIR No. 56 dated 01.07.2017 under Sections 406, 498-A IPC registered at Police Station Gardiwal, District Hoshiarpur. The petitioner is the brother-in-law (Nandoia) of the complainant. It is submitted that the petitioner has been falsely implicated in this case only due to his relationship with the complainant's husband. The petitioner lives separately and he has nothing to do with the matrimonial dispute between the complainant and her husband. Moreover, the petitioner has joined investigation and no recovery is to be effected from him. It is, thus, prayed that this petition be allowed.

Learned counsel for the State, on instructions from ASI Darshan Singh, Police Station Gardiwal, District Hoshiarpur, verifies that the petitioner has joined investigation and his custodial interrogation is not required. No recovery is to be effected from him. The petitioner is not reported to be involved in any other criminal case. Crl. Misc. No. M-29469 of 2017 [ 2 ] Keeping in view the facts and circumstances of the case but without expressing any opinion on the merits of the case, it is considered just and expedient to allow this petition. Consequently, order dated 25.08.2017 is made absolute.

None of the observations made here-in-above shall be construed to be a reflection on merits of the case and shall have no bearing on trial.
