R.P. Nagrath, J. (Oral) Petitioners seek bail under Section 439 Cr.P.C. in FIR No. 77 dated 28.07.2015 for offences under Sections 452, 354, 448, 427, 511, 506, 148 and 149 of Indian Penal Code (IPC) and Section 8 of the Protection of Children from Sexual Offences Act, 2012, registered at Police Station Singh Bhagwantpura, District Roop Nagar.

Heard.

Learned State counsel on instructions from HC Manjit Singh submits that there are four injured in this case, namely; the complainant, his sister, mother and brother. Injury on the person of Baljit Singh, brother of the complainant was grievous for attracting Section 325 IPC. The injury was on the left arm of Baljit Singh. The dispute was relating to the house. Learned counsel for petitioners submits that petitioners in fact own the property in question. This is, however, a disputed matter which is to be discussed during trial of the case.

CRM-M-29422 of 2015 -2Learned petitioners' counsel further submits that petitioners no. 1 to 4 are quite old persons. Petitioners are in custody since 27.07.2015 and it will take some more time in completion of the investigation and disposal of the trial.

In view of the above and without commenting on the merits of the case, the instant petition is allowed and petitioners be admitted to bail on furnishing bail bonds to the satisfaction of the Area/Duty Magistrate.
