Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Atma Singh, who has been booked for having committed the offences punishable under Sections 406 and 498-A, IPC, in a case arising out of FIR No.14, dated 18.07.2015, registered at Police Station, Women Cell Jagraon, Police District Ludhiana (Rural).

Learned counsel contends that the marriage of the petitioner with the informant, Rajvir Kaur, was solemnized on 18.03.2012; the petitioner was blessed with a daughter who is at present residing with the informant/complainant; the allegations levelled against the petitioner are general in nature and that the petitioner had filed a petition under Section 9 of the Hindu Marriage Act and as a counter-blast to the same, the present FIR has been lodged.

I have heard learned counsel for the petitioner and with SEEMA RANI 2015.09.01 16:32

[2] his able assistance gone through the material available on record. As per the allegations levelled by Rajvir Kaur, wife of the petitioner, from the very inception of her marriage she was being treated with cruelty not only by petitioner but by his mother as well. At the time of marriage, `3,00,000/- (Rupees three lacs only) in cash apart from the gold ornaments etc. were handed over to the petitioner and his mother but the same were usurped by them. It was also alleged that after consuming liquor, the petitioner used to beat Rajvir Kaur.

In view of the totality of the facts and circumstances of the case, no ground for grant of anticipatory bail to the petitioner, who is the main accused, is made out.

Dismissed.
