Through this petition under Section 439 Cr.P.C., petitionerJagu Ram, has prayed for grant of regular bail in case FIR No. 138 dated 23.04.2018, registered under Sections 406 and 420 read with Section 34 IPC and Section 3 of the Haryana Protection of Interest of Depositors in Financial Establishment Act, 2013 at Police Station Model Town, Rewari.

Learned counsel inter alia contends that the petitioner being agent/Manager had collected money on behalf of M/s Nav Jyoti BRF India Pvt. Ltd. and Seva Sehkari Samiti. He was only an employee and commission agent of the aforesaid accused-Company. He had not duped of any person. Petitioner is in custody since 24.04.2018. Conclusion of trial may take a long time. No useful purpose would be served by detaining the petitioner in jail.

On the other hand, learned State counsel vehemently opposed the above submission of learned counsel for the petitioner. 6.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Jagu Ram, is ordered to be released on bail pending trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
