Jaswant Singh,J.(Oral) Prayer is for grant of anticipatory bail under Section 438 Cr.PC on behalf of father-in-law of deceased in case bearing FIR No.478 dated 5.8.2015 under Sections 306/34 IPC, PS Sonepat City. As per allegations marriage of deceased Kavita was solemnised with Anand @Rinku about 9 years ago and a son was born out of that wedlock. Deceased Kavita and said Anand consumed poisonous substance in the parental home of deceased Kavita resulting into her death while her husband Anand somehow has survived. Petitioner is father of husband Anand and general allegations have been made by the complainant-father of deceased Kavita against him and rest of the family members qua harassment for RAJINDER PRASHAD JOSHI 2015.11.18 17:15 I attest to the accuracy and authenticity of this document High Court, Chandigarh.
CRM-M 29479/2015(O&M) bringing insufficient dowry resulting into committing of suicide by Kavita.
It was submitted that a total false case has been foisted upon the family of the husband. That apart, it is submitted that the petitioner-accused in compliance of the previous orders has already joined investigation and his custodial interrogation is no longer required.
Learned State counsel on instructions from SI Wazir Singh does not dispute that the petitioner has joined investigations and his custodial interrogation is no longer required. He,however, submits that report of FSL regarding handwriting on the suicide note is still awaited. In view of the above,interim bail granted by this Court vide order dated 10.09.2015 is made absolute.
Disposed of.
