In the High Court of Punjab and Haryana at Chandigarh .....

Criminal Misc. No.M-15268 of 2019 Date of decision:04.04.2019 Surinder Singh

...Petitioner

v.

State of Punjab

...Respondent

....

Coram:

Hon'ble Mr. Justice Inderjit Singh .....

Present:

Ms. Isha Goyal, Advocate for the petitioner.

.....

Inderjit Singh, J.

The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.188 dated 25.12.2017 registered for the offences under Sections 307, 323, 324, 148 and 149 IPC and (Section 307 IPC, which was added later on) at Police Station Kulgarhi, District Ferozepur.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that the present petitioner is named in the FIR. He was stated to be armed with a `Kirpan' and injury is also attributed to him which was given to Bhupinder Singh on his leg. Injury dangerous to life has been attributed to the co-accused. Keeping in view the facts and circumstances of the present case and the fact that the petitioner has played active role in the commission of HARPAL SINGH PARMAR 2019.04.05 16:51 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-15268 of 2019 [2] offence and the `Kirpan' is yet to be recovered, I find that he is required for custodial interrogation, therefore, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
