CORAM: HON'BLE MR. JUSTICE AMAN CHAUDHARY ***** Present :
None for the petitioner.
Mr. Arun Gupta, DAG, Punjab.
***** AMAN CHAUDHARY, J. (Oral) 1.
Prayer made in the present petition is for quashing the orders dated 26.06.2002, 17.06.2002 and 12.06.2002, Annexures P-5 to P-7, whereby the additional increment sought by the petitioner was declined. 2.
The claim of the petitioner was based on the benefit of promotional increment having been restricted to Sh. Jagmohan Lal Sharma, regarding which learned State counsel refers to para 8 of the merits of the written statement dated 23.01.2004, wherein it has been stated that there is no relevancy to the said case on account of the fact that he was promoted/posted as Superintendent in the Directorate Office on 12.04.1990 prior to issuance of Punjab Govt. Notification dated 15.06.1990, whereas the petitioner was posted in circle office on 03.10.1994, thus, the aforesaid notification was binding upon him and not entitled to additional increment by virtue of his posting in the said office, to which there is no rebuttal by filing any replication. 3.
Disposed of, reserving the petitioner with a liberty to get it revived, in case lis still subsists.
