Petitioner has filed this second petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.7 dated 19.01.2017 under Sections 420, 465, 467, 468, 471 and 120-B IPC (Section 420 IPC deleted later on), registered at Police Station Mahilpur, District Hoshiarpur. I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that earlier bail petition filed by the petitioner has already been dismissed by this Court on merits vide order dated 27.04.2017. In the said order, it has already been held that present petitioner is real nephew of the complainant and was knowing fully well that Kulwinder Singh and the complainant are residing in foreign country. The allegation of criminal conspiracy has been alleged against him along VINEET GULATI 2018.07.27 12:36 I attest to the accuracy and authenticity of this document Chandigarh with other co-accused and the petitioner executed sale deed of his share and

CRM No.M-30497 of 2018 -2in the same sale deed, share of Kulwinder Singh was sold by impersonation. No changed circumstance has been shown now.

Furthermore, in the earlier order dated 27.04.2017, this Court has held that petitioner is required for custodial interrogation. But, since then, he is avoiding his arrest.

Keeping in view the facts and circumstances of the present case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.

However, nothing stated above, shall constitute my opinion on merits of the case.
