(ORAL) The petitioner herein seeks the relief of regular bail in the criminal case as registered at Police Station Camp Palwal, District Palwal vide FIR No.109 dated 20.02.2021 under Sections 3, 4, 5, 6, 23 of the Pre-Natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act, 1994 and Sections 420/120-B IPC with the allegations that he accepted the deal money from the decoy (a pregnant lady) for getting the test for sex determination of her fetus, conducted. Learned State counsel has forwarded the pairavi report/status report, as sent by the concerned SHO qua the present

matter, to this Court which has been placed on the record. I have heard learned counsel for the petitioner as well as learned State counsel in the present petition and have also perused the file thoroughly.

Learned counsel for the petitioner contends that the Challan has already been presented and the petitioner has been in custody since 20.02.2021 in this case and he is also not involved in any other criminal case and therefore, he deserves the concession of regular bail. Learned State counsel does not dispute the above-referred factual position but he argues that the petitioner was arrested from the spot and the deal money to the tune of Rs.28,000/- had also been recovered from him and if released on bail, he may again indulge in the similar activities and hence, this petition be dismissed. Keeping in view the facts that the Challan has already been presented in this case and that the petitioner has been behind the bars since 20.02.
