Petitioner prays for grant of anticipatory bail in complaint case No.75 of 2010/2013, under Sections 363/376/120B/506/34 IPC titled 'Ishwar Singh v. Yogesh Kumar and others' pending before the learned Judicial Magistrate First Class, Mohindergarh.
This Court while issuing notice of motion on 27.01.2014 had directed that in case the petitioner surrenders before the Judicial Magistrate First Class, Mahendergarh on 10.02.2014, he shall be admitted to ad interim bail by the said court. Despite service, none had put in appearance on behalf of respondent No.2. Matter had been adjourned a number of times. CRM No.M-2967 of 2014 [2] Mr. S.S.Verma, Advocate, learned counsel for the petitioner informs that despite best efforts to contact the petitioner, no instructions are forthcoming. Learned counsel is unable to inform whether the petitioner indeed appeared before the Judicial Magistrate First Class, Mohindergarh on 10.02.2014.
The present being a complaint case, learned counsel for the State is also unable to furnish any information.
It appears that the petitioner is not interested in pursuing this matter.
