This is the second petition under Section 438 of the Cr.P.C., whereby, the petitioner has sought the relief of him being granted the concession of anticipatory bail in FIR No.77 dated 05.10.2023, under Sections 21/61/85 of the N.D.P.S. Act (Sections 27-A/29 of the N.D.P.S. Act added subsequently), registered at P.S. Mehta, District Amritsar. 2.

The earlier petition, i.e. CRM-M-11487-2024, wherein, the petitioner had sought an alike relief, as claimed herein, was dismissed as withdrawn by this Court, vide order dated 05.03.2024. 3.

Since there is no change of circumstances, nor any concrete supervening events have been brought before this Court, wherethrough, the instant second petition, on the same cause of action, can be permitted to be maintained, therefore, the instant petition is dismissed being non maintainable.
