(ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from NCB Crime No. 7/2018 dated 20.2.2018 under Sections 8/20/29 of the Narcotics, Drugs and Psychotropic Substances Act, 1985 (for short the "NDPS Act"), registered at Police Station NCB, Chandigarh. According to the prosecution, petitioner was apprehended for keeping in his conscious possession 4.015 Kg. of charas. Learned counsel for the petitioner contends that the petitioner is in custody since 20.2.2018. Co-accused of the petitioner namely Sham Lal has already been granted the concession of regular bail vide SONIKA 2019.03.01 23:55 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-30570 of 2018 --2-- order dated 29.01.2019 passed in CRM-M-33134-2018. Treating the case of the petitioner on the same parity, he may also be granted the concession of regular bail. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on interim bail till conclusion of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned. Disposed of.
