Through this petition under Section 439 Cr.P.C., petitionerRaju @ Rajpal, has prayed for grant of regular bail in FIR No. 126 dated 14.05.2018 registered under Sections 324, 341, 379-B, 427 read with Section 34 IPC at Police Station Bawani Khera, District Bhiwani. 2.
According to the prosecution, on 13.05.2018, the petitioner along with his three accomplice robbed complainant-Ram Niwas, while he was taking his truck to Bijnor, near village Jamalpur, District Bhiwani (Haryana) and snatched ` 20,000/- in cash from the purse of the complainant. The petitioner and his accomplices also snatched mobile phone of the complainant.

Learned counsel inter alia contends that two co-accused of the petitioner have already been enlarged on bail. The petitioner is not booked in any other case. He is in custody since 14.05.2018. On the other hand, learned State counsel vehemently opposed the prayer for grant of regular bail to the petitioner. 5.
I have given anxious consideration to the submissions made by learned counsel for the parties.

Considering the overall circumstances, but without expressing any opinion on the merits of the case and also that the trial is likely to take time, the instant petition is allowed. Petitioner-Raju @ Rajpal, is ordered to be released on regular bail pending trial, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
