(Oral) Prayer is for grant of regular bail in case having FIR No.28 dated 22.3.2021 registered under Sections 307, 324, 323,/34 IPC and Section 25/27 of Arms Act at Police Station Ghall Khurd, District Ferozepur. The counsel for the petitioner inter alia contends that the petitioner is in custody since last more than 10 months and is having no criminal history and now the matter has been compromised between the parties and in this regard compromise quashing petitions having CRM-M60341-2022 and CRM-M-60354-2022 have been filed. ( 2 ) CRM-M-18302-2022 The instant petition is opposed by the State counsel, who on instructions from ASI Lakhbir Singh submits that indeed matter has been compromised between the parties.
Counsel for the complainant has also admitted the factum of compromise and pleaded no objection if the present petition is allowed. I have considered the submissions made by counsel for the parties.
In view of the fact that petitioner is in custody for the last 10 months and further the matter has been compromised between the parties and trial is at its initial stage, no purpose is going to be served by keeping the accused behind the bars for any longer period. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
