Petitioner has filed the present petition under section 438 Cr.P.C. seeking pre-arrest bail as the trial court has issued non-bailable warrants due to his non appearance on one date of hearing i.e. 21.02.2019. Due to this reason, his bail-bonds were cancelled and surety bonds forfeited. Learned counsel for the petitioner submits that petitioner shall furnish an undertaking before the trial court that he shall not absent from proceedings on any date in future.

In view of above, present petition is allowed and it is directed that in case petitioner appears before the trial court within ten days from today, he shall be admitted to bail subject to such terms and conditions as the court may deem fit to impose as also furnish an undertaking as aforesaid.
