Mr. J.S. Sidhu, Advocate for the complainant. ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in FIR No.99 dated 21.07.2017 registered under Sections 379-B, 324, 148, 149 IPC (Section 326 IPC added later) at Police Station Kot Ise Khan, District Moga.

Counsel for the petitioner submits that in pursuance to the order dated 11.08.2017, the petitioner has already appeared before the Investigating Officer, joined the investigation and he is no longer required for any further investigation as no injury has been attributed to him.

Counsel for the State assisted by counsel for the complainant, on instructions from ASI Balbir Singh, has submitted that though the petitioner has joined the investigation but as per the allegation of the complainant, he has paid the amount to co-accused for causing injuries to the complainant. However, this fact is not disputed that the petitioner is no more required for any further investigation. It is Mohd. CRM No.M-29687 of 2017 further submitted that 04 other persons named in the FIR have already been arrested.

In view of the above, the petition is allowed and the interim bail granted to the petitioner vide order dated 11.08.2017 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
