RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.89 dated 28.06.2008 (Annexure P-1) under Sections 452, 325, 323, 34 IPC registered at Police Station City Mallanwala, District Ferozepur, on the basis of compromise dated 27.01.2016 (Annexure P-2) Pursuant to the order dated 22.02.2017 of this Court, the parties appeared before the trial Court on 08.03.2017 to get their statements recorded. Learned Additional Chief Judicial Magistrate, Ferozepur, has submitted her report vide letter bearing No.216 dated 18.03.2017 duly forwarded by learned District and Sessions Judge, Ferozepur vide letter No.2584/CB dated 20.03.2017.
According to the report, the Additional Chief Judicial Magistrate is satisfied that compromise entered into between the parties is genuine, voluntary, and without any inducement, threat or pressure. None of the Ravinder Singh 2017.09.13 14:33 I attest to the accuracy and authenticity of this document accused has been declared proclaimed offender in this case.
-2CRM-M-30568 of 2016 Considering the report of Additional Chief Judicial Magistrate dated 18.03.2017 and the fact that the compromise will bring harmony in relations between the parties, FIR No.89 dated 28.06.2008 (Annexure P-1) under Sections 452, 325, 323, 34 IPC registered at Police Station City Mallanwala, District Ferozepur, is hereby quashed. Petition is disposed of accordingly.
