Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.112 dated 14.09.2012 under Section 22 of the NDPS Act, registered at Police Station Sirhali, District Tarn Taran.

Notice of motion.

Ms.Simsi Dhir Malhotra, Deputy Advocate General, Punjab, who is present in the Court, accepts notice on behalf of respondent-State.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the impugned order dated 27.01.2015 (Annexure P2) passed by learned Addl. CRM No.M-29669 of 2015 -2absented from the proceedings. Even learned counsel for the accused (petitioner) did not come present, therefore, the Court cancelled the bail order and bail bonds as well as surety bonds were forfeited to State and non-bailable warrants were issued against the accused. Learned counsel for the petitioner placed on record the custody certificate dated 10.04.2015 issued by Superintendent, Sub Jail, Patti, showing that petitioner is in custody in another case from 13.08.2014 to 07.04.2015.

Keeping in view the facts and circumstances of the present case and further that no useful purpose will be served by keeping the petitioner in custody till the final disposal of the case, I accept the present petition. The petitioner is directed to appear before the trial Court within seven days and on doing so, he shall be released on bail by the trial Court to its satisfaction.

A copy of this order be given under the signatures of the Bench Secretary of this Court.
