The petitioner has approached this Court seeking quashing of complaint No.353 dated 16.3.2019 registered under Sections 138 and 142 of Negotiable Instruments Act on the basis of compromise.

I have heard the learned counsel for the petitioner. 3.

It transpires that the petitioner already stands convicted in the aforesaid complaint vide order dated 4.2.2020 pursuant to judgment dated 3.2.2020 passed by learned Judicial Magistrate 1st Class, Pehowa (Annexure P-2). The petitioner, however, did not challenge the aforesaid judgment by way of filing any appeal before the Court of Sessions. ( 2 ) CRM-M-19391-2021 (O&M) petitioner did not challenge the aforesaid judgment as negotiations for a compromise between the parties were going on which have yielded results and as on date the parties have amicably resolved the matter. 4.

Having heard the learned counsel for the petitioner, the petition is disposed off with liberty to the petitioner to challenge the judgment dated 3.2.2020 by way of filing an appeal before the Court of Sessions. In case, any appeal is filed within a period of 3 weeks from today accompanied by an application for condonation of delay, the Appellate Court shall take a lenient view in the matter while considering the delay condonation application keeping in view that the entire world has been facing the threat of pandemic COVID-19 and the Courts had virtually come to a standstill for a substantial period and also in view of the fact that the parties have amicably resolved their issues. 5.
