Present petition has been filed under Section 439 of the Code of Criminal Procedure (Cr.P.C.) for grant of concession of regular bail to the petitioner in case FIR No.05 dated 18.01.2021 under Sections 22 C, 25, 29, 61 and 85 of Narcotic Drugs and Psychotropic Substances Act registered at Police Station Dhanaula, District Barnala.

As per the allegations in the FIR, on receipt of secret information one Santro Car was intercepted and 1,25,000/- tablets of CELCIDAL 100 SR were recovered from the occupants of the car namely, Paramjit Singh and Sheeshu Singh. The name of the petitioner has surfaced on the disclosure statement of Sheeshu Singh, who allegedly stated that the petitioner also accompanied them to Delhi to procure the Contraband.

The petitioner was arrested on 29.03.2021. On the disclosure of the petitioner 500 intoxicant tablets were recovered. RASHMI 2021.07.10 13:29 I attest to the accuracy and integrity of this document

CRM-M-19208 of 2021 The alleged recovery from the petitioner is noncommercial quantity. Investigation in the case is complete. In view of the above and the fact that the trial is unlikely to conclude in near future more so in the wake of outbreak of pandemic COVID, no useful purpose will be served by keeping the petitioner in custody till the final disposal of the case. Accordingly, without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner-Harpreet Singh is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of the trial Court/Duty Magistrate, Chief Judicial Magistrate, concerned.
