HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No. 162 dated 23.04.2021 under Section 21 of the NDPS Act registered at Police Station City Mandi Dabwali, District Sirsa.

As per allegations, 40 grams of heroin was recovered from the petitioner.

Learned counsel for the petitioner submits that the petitioner has falsely been embroiled. The alleged recovery has already been effected and the same falls under non-commercial quantity. The petitioner has been in custody since 23.04.2021 and that no other criminal case except the present one is registered against him.

On the other hand, learned State counsel opposed the petition. Without commenting anything on the merits of the case and also bearing in mind the current Covid-19 situation where the trial proceedings are being adjourned from time to time, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Deepa is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. This present petition stands accepted accordingly.
