This petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking quashing of impugned order dated 19.12.2024 (Annexure P-3) passed by learned Additional Sessions Judge, Fazilka, whereby bail order of the petitioner has been cancelled, his bail/surety bonds were forfeited to the State and non-bailable warrants were issued against him in case bearing FIR No. 24 dated 09.02.2020 registered under Sections 399, 402 of Indian Penal Code, 1860 registered at Police Station City-I, Abohar, District Fazilka, Punjab (Annexure P-1) .

Learned counsel for the petitioner submits that petitioner was on bail and was regularly appearing before the learned Trial Court. However, due to some unavoidable circumstances, he could not appear before the learned trial Court. Subsequently vide order dated 19.12.2024, learned trial MOHIT 2025.08.11 12:35 I attest to the accuracy and integrity of this document

CRM-M-15175-2025 -2Court cancelled the bail of the petitioner and his non-bailable warrants were issued.

On 27.03.2025, following order was passed:- "Contends, inter alia, that non-appearance of the petitioner on 19.12.2024 was not intentional; rather it happened on account of passing away of his relative on 20.12.2024. Notice of motion.

Mr. Kunwarbir Singh, learned AAG, Punjab accepts notice on behalf of respondent-State; seeks time to have instructions and/or to file written response in the matter. Posted for 28.05.2025.

In the meanwhile, petitioner shall join proceedings before learned trial Court and on doing so, he be released on interim bail in the present case till the next date of hearing on furnishing adequate bail and surety bonds subject to his satisfaction." 4.

On instructions from ASI Kala Singh, learned State counsel submits that in compliance of the aforementioned order the petitioner has joined proceedings before learned Trial Court and has been released on bail. 5.
