Naresh Kumar Sanghi, J.(Oral) Learned counsel for the petitioner submits that the petitioner has also filed a complaint before learned Area Judicial Magistrate in which part preliminary evidence has been led and the case is fixed before learned trial court on 27.02.2015. On that date, the remaining preliminary evidence is likely to be led and thereafter, the case would be posted for consideration on the summoning order and as such, he may be permitted to withdraw the present petition at this stage with liberty to file fresh one in accordance with summoning order to be passed by learned court below.
Learned counsel for the State has no objection to the above said prayer.
