ARUN MONGA, J. (ORAL) Present petition has been filed under Section 438 of Code of Criminal Procedure, 1973 (for short 'Cr. P.C.') for grant of anticipatory bail to the petitioner in case FIR No.0128 dated 12.02.2023, registered under Sections 406, 420 of IPC, at Police Station Karnal Sadar. 2.

Learned counsel for the petitioner submits that pursuant to earlier order dated 11.04.2023 passed by this Court, petitioner has joined investigation and has fully cooperated in the same.

Learned State counsel per his instructions from ASI Bharat Bhushan submits that though petitioner has joined investigation but he has not paid balance amount of Rs.2 lakh, which she took from complainant from sending abroad.

In any case, same is matter of trial and custodial interrogation of petitioner is not required at this stage.

In view of the above, since custodial interrogation of petitioner is no more required and he has already joined investigation, present petition is allowed. Order dated 11.04.2023 granting interim anticipatory bail to the petitioner is made absolute, subject to petitioner's complying with provisions under Section 438(2) Cr.P.C.
