(ORAL) The present petition has been filed by the petitioner under Section 439 Cr.P.C for grant of bail pending trial in case FIR No.74 dated 30.07.2021 registered under Sections 21(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985, and Section 25 of the Arms Act, 1959, at Police Station Sarai Amant Khan, District Tarn Taran. It is submitted by the learned counsel for the petitioner that the case against the petitioner is totally concocted. The police have fabricated the alleged recovery from the petitioner. There is no other case against the petitioner. The investigation of the case is already complete. The petitioner is in custody since 31.07.2021. Hence, the petitioner deserves to be released on bail pending trial.

2023:PHHC:098540 CRM-M-18449-2022 -2from ASI Sikhdev Singh, has submitted that the commercial quantity of heroin has been recovered from the petitioner. The charge in the case was framed only on 17.07.2023 and in a short span thereafter, the prosecution has already examined as many as six witnesses. Only eight witnesses are left to be examined. Even the said witnesses will be examined by the prosecution with due promptitude.

In view of the above submissions made by the learned counsel for the State, this Court does not find it appropriate to grant concession of bail pending trial.

Dismissed.
