The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.117 dated 18.10.2018 registered for the offences under Sections 304, 342, 148 and 149 IPC and (Sections 302 and 364 IPC, which were added later on) at Police Station City Fazilka, District Fazilka.

I have heard learned counsel for the petitioner and have gone through the record.

As per the FIR, the present petitioner along with other persons have abducted the complainant and tied him with a `Kikar' tree and then gave beating for the entire night and kept on pulling his finger nails with pliers etc. In the morning, Bishambar Singh, Sarpanch of Village Gaganke informed the Police at Police Station Sadar Fazilka and the Police came at the spot and got him released. The complainant later on succumbed to the HARPAL SINGH PARMAR 2019.04.05 16:51 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-15466 of 2019 [2] injuries.

Keeping in view the facts and circumstances of the present case; nature and gravity of the offences and the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
