ARUN MONGA, J.(ORAL) Having suffered concurrent adverse findings by two Courts below, defendant/appellants are in second appeal before this Court assailing judgment and decree dated 08.09.2000 passed by learned trial Court, as upheld by learned First Appellate Court vide judgment and decree dated 08.10.2001, decreeing suit for permanent injunction filed by plaintiff/respondents.

Appeal was admitted on 08.12.2003. Case was taken up for hearing on 07.02.2023 when Registry was asked to issue notice to learned counsels for the parties.

Office report reveals that learned counsel for appellants was informed through e-mail. Today no one has caused appearance on behalf of parties, despite service.
