******* SURINDER GUPTA, J.(Oral) These are the petitions filed under Section 438 and 482 of Code of Criminal Procedure for grant of anticipatory bail and setting aside of order dated 30.07.2014, declaring the petitioner as proclaimed offender in case FIR No. 160 dated 08.06.2013 registered for the offence punishable under Section 15 of Narcotics Drugs and Psychotropic Substances Act, 1985, at Police Station Phillaur, District Jalandhar. Heard.

Learned State counsel on instructions from HC Gurdeep Singh submits that the petitioner has not joined the investigation. Learned counsel for the petitioner submits that the petitioner had gone twice to join the investigation but she was not allowed. CRM-M-30694 of 2016 -2order dated 04.08.2017, the petitioner was directed to appear before the investigating officer on 09.08.2017. It was further ordered that in the event of her being not allowed to join the investigation, she will move application supported by affidavit before the Sub Divisional Judicial Magistrate/Duty Magistrate, Phillaur, who will verify the facts from the investigating officer and report.

Admittedly, the petitioner has not moved any such application before the Sub Divisional Judicial Magistrate/Duty Magistrate, Phillaur, which shows that she is deliberately avoiding to comply with direction given to her to join investigation vide order dated 04.08.2017. Vide order dated 04.08.2017 passed in CRM-M-30764-2016, petitioner was directed to surrender before the Illaqa Magistrate/Duty Magistrate within seven days and on her appearance, she was ordered to be released on interim bail but she has also not complied with that order as well.

Keeping in view above facts, both the petitions are dismissed for non-compliance of order 04.08.2017 passed in both the petitions.
