The petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.25 dated 26.3.2016 registered for the offences under Sections 302, 307 and 34 IPC and (offences under Sections 148, 149, 323, 324, 326 and 120-B IPC, which were added later on) at Police Station Barnala. Notice of motion was issued in this case.
Ms. Monika Jalota, learned Deputy Advocate General, Punjab has appeared on behalf of the respondent-State and contested this petition. I have heard learned counsel for the petitioner as well as learned Deputy Advocate General, Punjab appearing for the respondentState and have gone through the record.
Cr. Misc. No.M-30765 of 2018 [2] As per the FIR version, it is a honour-killing case. Veerpal Kaur got married with Baljit Singh (since deceased) against the wishes of her parents and society. On 26.3.2016 at about 5.30 a.m., she along with her husband were present at Bus Stand Dhanaula Khurd, where her father along with other persons including the present petitioner attacked Baljit Singh, who was killed and Veerpal Kaur was seriously injured. The present petitioner though not named in the FIR, which was got recorded by Bhura Singh-complainant, but in her statement which was recorded after three days of the occurrence under Section 161 Cr.P.C., Veerpal Kaur had named the present petitioner also. Keeping in view the serious allegations, nature and gravity of the offences, I do not find it a fit case where the present petitioner is entitled to the benefit of regular bail.
Therefore, finding no merit in this petition, the same is dismissed.
However, since the occurrence is of 26.3.2018, the learned trial Court is directed to expedite the trial by giving short adjournments, even day to day adjournments, if required. The Investigating Officer and SHO of concerned Police Station are directed to produce the remaining witnesses before the trial Court on the next 2-3 dates. The Senior Superintendent of Police, Barnala will personally look into the matter that all the witnesses are produced before the Court expeditiously as ordered above. August 13, 2018.
